How a Business Dispute Moves
Most disputes end well before trial. Where they end usually depends on how the first two steps are handled.
- Position. We read the contract, the correspondence, and the conduct, and tell you what your actual leverage is rather than what you hope it is.
- Demand. A letter that states the claim precisely and shows the other side what litigation would look like. A good many matters end here.
- Suit. Filed in Supreme Court, or in the Commercial Division where the matter qualifies, with any provisional relief sought at the outset.
- Discovery. Documents, emails, and depositions. In commercial cases the electronic record usually decides who is right.
- Motions. Dispositive motions can end the case or narrow it to the issues genuinely in dispute.
- Resolution. Settlement, mediation, or trial, chosen on the numbers rather than on principle.

When a deal goes wrong, the argument is almost always about one of these. They are worth the time at drafting, when they cost nothing.
